SCHWANDNER LAW FIRM RECOVERS $1 MILLION SETTLEMENT FOR GENERAL CONTRACTOR AGAINST OHIO COUNTY
Nick Schwandner, on behalf of his general contractor client, successfully litigated and recovered from an Ohio county a $1 million settlement after the Ohio county wrongfully terminated the general contractor allegedly “for cause.”
The county on this municipal sanitary sewer project had alleged purported “delays” to the construction project and unilaterally terminated the contractor before the project could be completed. Nick worked with the contractor and together they showed that the alleged delays were the responsibility of the county, not the contractor. The county’s action in declaring the contractor in default and terminating were wrongful, and those actions by the county were in fact the county breaching the contract. Of note, it came to light that the project drawings put out for bid by the owner had been misleadingly dated and were actually so old that they were erroneous when used during bidding and the notice to proceed. Nick and the general contractor further prepared a strong differing site conditions claim for unexpected subsurface rock and unsuitable soil conditions. Ultimately, a settlement was reached recovering $1 million in damages for the general contractor and converting the termination for cause to a termination for convenience.
